THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
We are required by law to maintain the privacy of your protected health information (PHI), provide you with notice of our legal duties and privacy practices with respect to your PHI, notify you following a breach of unsecured PHI, and abide by the terms of the notice currently in effect.
We may use and disclose your PHI to provide, coordinate, or manage your health care and any related services. This includes dispensing your prescriptions and communicating with your physician or other health care providers regarding your treatment.
We may use and disclose your PHI to bill and collect payment for the services and items provided to you. This may involve contacting your health insurance company or pharmacy benefit manager (PBM) to determine eligibility or coverage.
We may use and disclose your PHI for our internal pharmacy operations. These uses and disclosures are necessary to run the pharmacy and ensure our patients receive quality care. This includes quality assessment, reviewing the competence or qualifications of our pharmacists, and general business management.
We may use and disclose your PHI to contact you by phone, mail, email, or text to provide appointment reminders, refill reminders, or information about treatment alternatives or other health-related benefits and services that may be of interest to you.
We will disclose your PHI when required to do so by federal, state, or local law. We may also disclose your PHI for public health activities, such as reporting adverse events to the FDA, reporting disease to public health authorities, preventing disease, or averting a serious threat to health and safety.
We may disclose your PHI to our business associates (vendors) that perform functions on our behalf. They are contractually obligated to protect your information. We may also disclose your PHI to health oversight agencies (e.g., DEA, FDA, pharmacy boards) for audits, investigations, and licensure actions.
Other uses and disclosures of your PHI not covered by this notice or the laws that apply to us will be made only with your written authorization. We specifically require your authorization for most uses and disclosures of psychotherapy notes, uses and disclosures for marketing purposes, and disclosures that constitute a sale of your PHI. If you provide us authorization to use or disclose your PHI, you may revoke that authorization, in writing, at any time.
We are required by law to maintain the privacy and security of your protected health information. We reserve the right to change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, in our office, and on our website.
We collect the following types of information when you interact with us or use our website:
We do not sell your personal information or protected health information to third parties for monetary consideration.
We use cookies, web beacons, and analytics tools to collect technical information about your interactions with our website. You can control cookies via your browser settings, though this may impact site functionality.
We do not use tracking to build advertising profiles based on health conditions or prescription history, and we do not use geofencing around health care facilities.
We use phone, email, and SMS to send prescription-ready notices, refill reminders, appointment reminders, and account or service communications. Message and data rates may apply. You may opt out at any time (e.g., by replying STOP to texts, clicking unsubscribe links, or contacting us as outlined in Section 19).
Opting out of marketing or reminder communications does not affect legally or clinically required communications. We do not sell or share your phone numbers or email addresses with third parties for their own marketing.
Under the Nevada Consumer Health Data Privacy Law, a distinction is made between HIPAA-covered Protected Health Information (PHI) and Nevada consumer health data. We are committed to obtaining your consent for specified purposes before collecting or sharing your consumer health data. We require separate, explicit authorization before any sale of consumer health data, and we explicitly state that we do not sell consumer health data. Furthermore, we do not implement geofencing around health care facilities to identify or track individuals seeking health services. You have the right to confirm our processing of your health data, request access to it, and request its deletion. To exercise these rights, please contact us using the information provided in Section 19.
Depending on your state of residence—such as California (under the CCPA), Colorado, Virginia, Connecticut, Utah, and other jurisdictions with similar laws—you may have additional privacy rights regarding your personal information. These potential rights include the right to know what data we collect, access or obtain a copy of your information, correct inaccuracies, request deletion, and opt out of certain sales, sharing, or targeted advertising. Please note that health information covered by HIPAA is generally exempt from these state consumer privacy laws. To exercise any applicable state rights, please submit a request via the contact methods detailed in Section 19. We will verify your identity to process your request and will not discriminate against you for exercising your privacy rights.
This Site and our Services are intended for adults. We do not direct the Site to children under the age of 13, and we do not knowingly collect personal information from children under 13 without appropriate parental or guardian involvement. If you believe a child has provided us with personal information, please contact us.
We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information and PHI against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use, in alignment with the HIPAA Security Rule and applicable state law. However, no method of transmission over the Internet or electronic storage is completely secure.
We retain your PHI and personal information for as long as necessary to provide our services and fulfill the purposes described in this Policy. We also retain information as necessary to comply with our legal, regulatory, and recordkeeping obligations (including state board of pharmacy and HIPAA retention requirements), resolve disputes, and enforce our agreements. When information is no longer needed, we securely delete or de-identify it.
Our Site may contain links to third-party websites or services (for example, a payment processor or a refill-request platform). This Policy does not apply to those third-party sites or services. We encourage you to review the privacy policies of any third-party site you visit.
We may update this Notice of Privacy Practices and Website Privacy Policy from time to time. We will indicate the "Last Updated" date at the top of the policy. If we make material changes, we will post the updated policy on our Site and provide any additional notice as required by law.
If you believe your privacy rights have been violated, you may file a complaint with us by contacting the Privacy Officer using the information in Section 19.
You may also file a complaint with the U.S. Department of Health and Human Services (HHS) Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-800-368-1019, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/.
Nevada residents may also file complaints with the Office of the Nevada Attorney General.
We will not retaliate against you for filing a complaint.
